These terms describe the rules for using trioprod.com and engaging TrioProd as a SaaS factory. Individual SaaS products may have their own product-specific terms.
Scope of these terms
These Terms & Conditions apply to trioprod.com, business inquiries, proposals, invoices, and direct engagements with TrioProd. They do not automatically govern every SaaS product, app, platform, subscription, or user account created, owned, operated, or launched by TrioProd.
Product-specific terms
Every SaaS product may have its own Terms of Service, Privacy Policy, subscription rules, acceptable use rules, AI usage notices, refund rules, and support terms. For example, Babika.ai may publish separate terms that apply to Babika.ai accounts, users, data, billing, subscriptions, and product features. If a product has its own terms, those product terms control that product experience.
Acceptance of these terms
By using trioprod.com, contacting us, approving a proposal, paying an invoice, or starting a direct engagement with TrioProd, you agree to these Terms & Conditions and any written proposal, statement of work, order form, or agreement that applies to your engagement.
SaaS factory work
TrioProd creates, launches, and operates SaaS products, including our own product lines and product work for founders or teams. Our factory work may include MVP development, AI integration, product strategy, React and Next.js development, developer capacity, technical consulting, cloud deployment, CMS-led growth systems, support tooling, and related product operations. Specific deliverables, timelines, assumptions, fees, and acceptance criteria are defined in the applicable written scope.
Client responsibilities
- Provide accurate project information, timely feedback, access credentials, content, assets, and approvals needed for delivery.
- Confirm that you have the right to provide any materials, data, brand assets, code, or third-party access shared with us.
- Review deliverables promptly and report issues within the review period stated in the project scope or invoice terms.
- Maintain your own business, legal, compliance, privacy, security, and regulatory responsibilities for your product, users, data, and market.
Payments and invoices
Fees, billing milestones, deposits, retainers, payment schedules, currencies, and taxes for direct TrioProd engagements are stated in the applicable proposal, invoice, or written agreement. Unless stated otherwise, payments are due according to the invoice terms. Late or failed payments may pause delivery, support, release access, or account handoff until the account is current. Product subscriptions, credits, usage fees, or account billing inside a specific SaaS product are governed by that product's own terms where available.
Intellectual property and ownership
Unless a written agreement says otherwise, the client owns custom project deliverables created specifically for the client after all required payments for those deliverables have been received. We may retain ownership of pre-existing tools, templates, know-how, generic code patterns, internal processes, and reusable components that were not created exclusively for the client.
Third-party services
SaaS products and TrioProd engagements may rely on third-party services such as hosting platforms, payment processors, AI providers, analytics tools, repositories, CMS platforms, authentication providers, communications tools, and APIs. Third-party services are governed by their own terms, pricing, availability, security practices, and limitations.
Website content
Website content is provided for general business information. It is not a guarantee of results, timelines, rankings, revenue, funding, performance, or legal compliance. We may update, replace, or remove website content at any time.
Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, punitive, or loss-of-profit damages arising from website use, project delays, third-party services, data issues, business decisions, or services provided. Any direct liability is limited to the amount paid to us for the specific service giving rise to the claim, unless a written agreement states otherwise.
